Location & Format
Courses are available online or on-site. On-site sessions may take place in parks or rented venues in Tokyo or Kanagawa, depending on the season and group size. The exact location is arranged with the client in advance, either via email or in person.
Online sessions are clearly marked on the schedule and accessible via secure video platforms.

We select the most suitable platform based on the session type and client preference. Access links are provided via email after registration and payment, at least two hours before the session starts.

Vitality Flame – Service Description
We provide online and on-site fitness services for participants with at least intermediate-level English proficiency . Our leading service is the Aviva Method courses and practice sessions, where we teach and lead practice sessions of a specialized exercise program designed to support hormonal balance, fertility, and reproductive health.

Please note:
Vitality Flame reserves the right to make changes to its course offerings without prior notice. This includes adding or removing courses, modifying course names, content, schedules, and duration.
Clients find our services through our official website, social media, and personal referrals. Most of our sessions and programs are offered with one-time payment options.
Service Provision Timing

Courses consist of mainly 2 sessions of 2 hours each. The approximate duration is indicated on the product page.

Practice classes last 1 to 1.5 hours.

Schedules for group lessons and practice classes are shown in advance in the “Product Description” section of each product page (not on the homepage or course list).

Private sessions can be booked through contacting with the instructor by email, and are held at a mutually agreed date and time.

When clicking the “Enroll” button, you can see the lesson options, prices, and available times or booking calendars.
Payment Terms:
Clients confirm their registration for courses or practice sessions by completing the payment. Sessions are conducted at pre-agreed dates and times. All payments are securely processed as one-time transactions through our website.
All product prices are listed on the Product Pages, including on the shop and chart pages (not on the homepage).
Refund Policy:
Due to the nature of personalized coaching services, we generally do not accept cancellations or offer refunds once a session or program is booked. However, we may make exceptions on a case-by-case basis in the event of special circumstances.
2. Nature of Services
The services provided by Vitality Flame are delivered by a certified Aviva Method Instructor and include:

These services are strictly instructional and informational. The instructor does not provide medical advice, diagnosis, treatment, or therapy. Participants are responsible for consulting their own healthcare providers regarding any health concerns.
All courses, sessions, and materials provided by Vitality Flame are strictly educational and informational.

3. Health Restrictions and Contraindications
Your safety is our priority. Please do not practice the Aviva Method in the following cases unless you have received explicit medical clearance:

⚠️ Special Case: Endometriosis
Practice is not recommended during certain stages, especially if hormonal therapy is being used to suppress menstruation before surgery. Always consult with a healthcare professional before beginning.
Eligibility Restrictions
The following individuals are not eligible to participate in our classes. If an existing member is found to fall into any of these categories, the studio reserves the right to revoke their membership:

Individuals who have been advised by a doctor not to engage in physical activity due to health conditions.

Individuals with contagious diseases that may pose a risk of group infection.

Pregnant individuals without a doctor’s approval to exercise.
-
Members of organized crime groups, anti-social organizations, or individuals involved in drug use.

Individuals who have been previously expelled from the studio.

Individuals under the influence of alcohol.
-
Anyone the studio determines is unable to safely or appropriately use the facilities.
4. Participation and Risk Acknowledgement
By registering for a course, you acknowledge and agree that:

You are participating at your own risk or with your doctor’s approval.

You will practice the exercises safely and regularly, in a suitable environment.

You waive all rights to claim compensation or take legal action against the developer, author, or instructor for any changes in your health.

You understand that completing this course does not entitle you to teach the Aviva Method or integrate it into any other system.

For online sessions, it is your responsibility to ensure a proper learning environment (stable internet, clear camera setup, quiet space, and room for movement).
If these conditions are not met and the session is extended as a result, the cost of the additional time will be charged to the participant. Thank you for your understanding.
You must agree to these conditions before proceeding with registration.
5. Bookings, Payments & Refunds
- Participants can use Vitality Flame’s online shop and reservation system via computer or smartphone to make, modify, or confirm their bookings. Reservations are considered confirmed once the payment has been made and a confirmation message and/or email is sent through the system.

Payments are processed securely through Stripe, which supports major credit cards and electronic payments. Stripe ensures that your payment information is encrypted and handled in compliance with industry standards.
- In addition, participants may request schedule changes or cancellations by contacting the instructor directly via email.
- Members are responsible for managing their own login credentials and preventing unauthorized access.
- Please note that Vitality Flame reserves the right to modify or suspend the online reservation service without prior notice and is not liable for any inconvenience or damages that may result.
- All course fees are listed and charged in Japanese Yen (JPY). Prices include any applicable taxes unless otherwise stated. No additional fees other than the stated price unless explicitly mentioned.
- Please ensure that your payment method supports transactions in Japanese Yen. Vitality Flame is not responsible for any additional fees (such as foreign transaction fees) imposed by your bank or payment provider.
- Vitality Flame reserves the right to revise all fees or related charges at its discretion, without requiring prior approval from members.
- All actual prices and available discounts are clearly displayed on each product page, along with their respective expiration dates.
- All prices are displayed on the product/course pages in Japanese Yen (JPY) and include applicable taxes unless otherwise specified.

The instructor may issue additional discount coupons via email.

Coupons must be redeemed according to the terms specified by the instructor.

Expiration dates and usage conditions will be clearly stated with each coupon.

All course fees are non-refundable.

If a class is cancelled by the instructor, it will be rescheduled at no extra cost.

If you notify us of cancellation at least 24 hours before the class, you are eligible to reschedule.

No rescheduling is offered for late cancellations or no-shows.
- Closure Policy
In the event of studio closure due to natural disasters, social conditions, or other unforeseen circumstances, all remaining classes and unused passes will be considered void.
By purchasing a class or pass, clients agree not to seek compensation or damages resulting from such closure.
Notifications
Clients will be informed of important updates — such as schedule changes, cancellations, or studio closures — via the email address provided at the time of booking.
Some notifications may also be posted on the homepage for general access.
Please ensure your contact information is up to date to receive all relevant communications.
Facility Usage:
Participants use the park, rented room, or studio facilities at their own risk.
Members are responsible for any damage caused to equipment or studio/room property.
The studio is not liable for theft or loss of personal belongings during use.
Lost and found items will be kept for 2 weeks before being discarded.
6. Recording Policy
To protect the intellectual property of the instructor and the privacy of all participants:

No recording of any kind (audio, video, screen capture) is allowed.

Participants may take notes by hand and optionally purchase a textbook.
-
Unauthorized recording or sharing of course content will result in removal from the course with no refund and may lead to legal action.
7. Intellectual Property
All content on this website (text, videos, images, materials) is the property of Vitality Flame and may not be copied, shared, or used for commercial purposes without prior written consent.
The Aviva Method and its associated trademarks are legally protected and may not be used without authorization.

⚠️ Recording of any part of the course or practice sessions is strictly prohibited.
⚠️ The method is provided for personal use only and is practiced entirely at your own risk.
⚠️Completing the Aviva Basic Course does not allow participants to teach, represent the Aviva Method, or integrate it into other systems in any form.
8. Limitation of Liability
Participants are expected to be mindful of their own physical condition and participate within their personal limits. The instructors cannot be held liable for any accidents or injuries that occur during classes. By participating in the classes, workshops, and practicing sessions, members acknowledge their personal responsibility and are asked to act considerately, avoiding any behavior that may cause inconvenience to the instructors or fellow participants.
Vitality Flame and its instructors are not liable for any injuries, damages, or health issues arising from participation in the exercises or use of the website’s content.
Membership Suspension and Expulsion
Vitality Flame reserves the right to suspend or terminate the membership of individuals who violate studio policies or cause disruption or inconvenience to other members or staff.
9. Privacy
Your personal information is treated with respect and in accordance with our Privacy Policy
10. Governing Law
These Terms are governed by the laws of Japan. All disputes shall be settled in the courts of Tokyo, Japan.
11. Amendments
We may update these Terms and Conditions from time to time. Continued use of the website implies acceptance of the revised terms.

In adapting the business to operate in Japan, the following Japanese laws are applicable:

III. DEFINITIONS
Sales Contract: An agreement under which the seller is obligated to transfer ownership of goods or provide services, and the buyer is obligated to pay for and accept them.
Goods: Includes products, real estate, rights of value, or services.
Parties: The Service Provider and the Customer collectively.
Consumer: A natural person acting outside their business or professional activity who purchases, orders, receives, uses, or is the recipient of commercial communication or offer regarding goods.
Consumer Contract: A contract where one party qualifies as a consumer.
Website: An online interface that allows for communication between parties and the establishment of contracts remotely.
Customer: Any person who pays the service fee and uses the service.
Online Service Agreement: A service agreement concluded via a website or other electronic means.
Contract: An agreement established between the Service Provider and the Customer through the website or electronic communication.
Service: Any activity performed for compensation other than selling tangible goods or real estate, intended to meet the customer’s needs.
Service Agreement: A contract where a business provides a service to a consumer for a fee.

Distance Contract: A consumer contract concluded without simultaneous physical presence using only remote communication.
Business: A person acting within the scope of their profession or business.

Currency Display: All prices on this site are listed in Japanese Yen (JPY/円) or US dollars (USD/$).
Note for International Visitors: Payments are processed via Stripe. Depending on your country and bank, currency conversion fees may apply.
IV. SCOPE AND ACCEPTANCE OF THE TERMS
The content of the agreement between the Parties is governed by these Terms and Conditions (T&C), along with relevant mandatory Japanese laws and any additional notices provided on the website.
The T&C outlines the rights and obligations of both Parties, the conditions for contract formation, delivery timelines, payment terms, responsibility provisions, and withdrawal rights.
Customers must read and understand the T&C prior to finalizing any order.
By placing an order through the website or other digital means, the Customer accepts the provisions of the T&C and acknowledges that the order implies a payment obligation.
The T&C form an integral part of any contract concluded between the Service Provider and the Customer.
V. CONTRACT LANGUAGE
The language of the contract under these T&C is English.
VI. CONTRACT STORAGE
Contracts under these T&C are not individually stored. They are not accessible after conclusion.
VII. CONTRACT FORMAT
The contract is not considered a written contract under Japanese law.
VIII. CODE OF CONDUCT
The Service Provider does not adhere to any specific code of conduct.
IX. PRICING
Prices are indicated in Japanese Yen (JPY) or US dollars (USD).
Displayed prices represent the full amount payable by the Customer in consumer transactions.
The Service Provider reserves the right to change prices at any time.
X. CUSTOMER COMPLAINT HANDLING AND DISPUTE RESOLUTION
Customers may submit complaints related to the goods or services via:

Complaints may be submitted verbally or in writing. The Service Provider will investigate verbal complaints immediately, where possible. If immediate resolution is not possible, or if the Customer disagrees with the handling, a written record will be made and provided to the Customer.
All written complaints will be answered within 30 days of receipt unless Japanese law stipulates otherwise. If the complaint is rejected, the Service Provider must justify their decision.
Records of complaints and responses will be retained for 3 years.
If a dispute cannot be resolved through direct communication, the Customer may seek resolution through:
Consumer Affairs Center (Japan): Consumers may consult the nearest National Consumer Affairs Center (Kokumin Seikatsu Center). Website: https://www.kokusen.go.jp/
Court Proceedings: Customers (including non-consumers) may enforce their legal claims through civil court proceedings under the Japanese Civil Code and the Code of Civil Procedure.
Alternative Dispute Resolution (ADR): Customers may request resolution through a designated ADR organization. Before doing so, they must attempt to resolve the issue directly with the business.
For assistance, the Customer may contact the Japan Consumer Support Portal or their local Consumer Affairs Office.
Course Cancellation and No-Show Policy
Once a course has been paid for, there is no refund if the customer later decides not to attend or cannot show up. However, if the customer notifies the Service Provider in advance, a rescheduling option will be provided.
